Rosland Capital Gold IRA Clients: What to Do With Your Account After the 2026 Bankruptcy

What happened to Rosland Capital, and what should Gold & Silver IRA clients do now?
Rosland Capital filed for Chapter 11 bankruptcy on July 2, 2026. If your precious metals are held in your IRA at an independent depository, you should be safe. However, you should act today to remove Rosland Capital as your interested party or designated representative. How Rosland Capital ended up in bankruptcy.
On July 2, 2026, Rosland Capital LLC filed for Chapter 11 bankruptcy protection (Case No. 2:26-bk-16650). The Southern California dealer was best known for their spokesman, William Devane, and his television commercials.
A Bondoro Insights report of court filings indicate the company:
- Owes approximately $49 million to customers who paid for metal but never received it.
- Plus $11.8 million to clients who sold metal back to them but never received the proceeds.
- Has no inventory of precious metals on hand.
- Is being investigated by the Securities & Exchange Commission (SEC).
The company ran a “sell first, buy later” business model.
They would receive clients money, then purchase the metal from third-party suppliers at a later point. But as the price of gold rose to over $5,000 oz in early 2026, the gap between what customers had paid and Rosland’s cost to buy their metal became unmanageable, resulting in a months-long backlog they couldn’t dig out of.

A familiar name at the center.
Rosland was founded in 2008 by its CEO Marin Aleksov, who according to his personal About Me page, had previously spent nine years at Lear Capital, and time at Merit Financial before starting his own company.
Merit Financial was sued and settled with the Santa Monica City Attorney in a massive false advertising and bait and switch case in 2015. Merit Financial went out of business shortly after the settlement.
Lear Capital has faced multiple government actions over alleged deceptive sales practices. New York secured a $6 million settlement, while regulators across 42 states and territories helped establish a $5.5 million investor compensation fund. What does this mean if you have a Rosland gold IRA?
It depends entirely on where your metal actually is. Rosland customers will typically fall into three groups:
- You paid for your metal either outright or through an IRA but never received it. Your claim is against the bankruptcy estate. Unfortunately, this is the one situation where no dealer — including us — can help you recover funds. (See the next section.)
- Your metal is already in your IRA at an independent depository. Your metal was delivered some time ago and is out of Rosland’s grip. You should be in good shape and have time to decide your next step.
- You bought “premium”, “exclusive”, semi-numismatic or limited edition coins at a steep markup. You may own real metal, but were overcharged for it. You have options to understand what it’s actually worth and simplify going forward.

If you paid for but never received your metal.
If you sent Rosland money for metal, either personally or through an IRA, and it was never delivered, court filings indicate you are likely an unsecured creditor of the estate. That means:
- Recovery, if any, happens only through the bankruptcy court.
- File a proof of claim (provide your personal information) if and when the court directs, and monitor notices from the U.S. Trustee and the case docket (No. 2:26-bk-16650).
We want to be straight with you here, this is by far the most difficult situation. The best thing we can offer is honesty about where you stand, as unfortunate as it is.
If your metal is already in your IRA.
Here’s the reassuring part. If your gold or silver is held in an IRA account, at an independent depository (for example, Delaware Depository, IDS, or Brink’s), then:
- Your metal is owned by your IRA and stored independently. Rosland’s bankruptcy doesn’t put your precious metals at risk.
- You do not have to do anything today. Your holdings don’t disappear because the dealer that sold them is gone.
- You still have a fully functioning IRA — you simply no longer have a dealer to call when you want to buy, sell, or take a distribution.
That last point is worth delving into.
Your custodian doesn’t buy or sell precious metals, so you need a dealer.
Your custodian and gold dealer have two different functions:
- Your custodian (the IRA administrator) holds your account, handles paperwork, and coordinates storage at the depository. Many Rosland clients have their IRAs at custodians such as Equity Trust, Strata Trust or GoldStar Trust.
- Your dealer is who you buy metal from and sell metal back to. Rosland was the dealer.
Here’s the key: when you want to sell, your custodian doesn’t buy your metal — they tell you to find a dealer. With Rosland gone, that’s a gap you’ll need to fill when the time comes.

Do you need a dealer on standby?
Most people reading this won’t want to sell their gold and silver, and you don’t have to. In fact, for most clients whose precious metals are safely held in an IRA, you’re not in a hurry, you’re not in crisis, you just lost the dealer you would have called someday.
Here’s the reassuring truth: the right move is often to do nothing right now.
- Your metal stays put and keeps working as part of your retirement account.
- You don’t owe anyone a decision — not us, and definitely not a cold-caller.
- You just keep a dealer you trust on hand for the day you actually need one: an upcoming RMD, a future sale, or simply a question about what your holdings are worth.
Think of it as a name in your back pocket. When that day comes, you’ll want a dealer who’s been around, prices competitively, and won’t pressure you — and you’ll already know who to call. Until then, there’s nothing you have to decide — though there is one small piece of housekeeping worth knowing about.
One quiet piece of housekeeping: is Rosland still on your account?
Even if your metal is safely at the depository and everything looks fine, there’s one detail worth checking. When you opened your account, Rosland was very likely listed as the Designated Representative on it — and depending on your custodian, that role can be similar to a power of attorney over your account.
To be clear: we don’t think the risk here is large. Rosland is defunct, its employees are gone, and the company is in liquidation. This isn’t cause for alarm.
But here’s something to consider: do you really want a bankrupt company — one known for taking advantage of its customers — left with any role or influence over your retirement account, however small? Most people, understandably, would rather clean that up.

Heads up: expect a wave of sales calls.
The court filings state that Rosland’s customer database is being auctioned off, that list of clients, including you — will most likely end up in the hands of another company. That means that:
- You’ll likely start getting unsolicited calls from a dealer who bought or obtained the list.
- High-pressure “act now” pitches are common in this industry after a competitor collapses. This is a known industry pattern, not an accusation against any specific buyer of the list.
- You are obviously not obligated to do anything because someone called you. A legitimate dealer is fine with you slowing down, comparing options, and calling them when you’re ready.

How to sell or move your gold IRA.
When you’re ready — whether that’s to sell your precious metals, move the funds to another custodian, or liquidate enough to take a distribution — the path is straightforward:
- To sell metal held in your IRA: we’ll provide you with a buyback quote, help you complete the required documents and then coordinate with your custodian and depository. Once the metal is sold and we wire the proceeds to your IRA, you can transfer them to another custodian or take a distribution.
- To take a Required Minimum Distribution (RMD): you can sell just enough metal to cover the RMD amount and withdraw the cash, or take an “in-kind” distribution of the metal itself.
A few important reminders:
- Withdrawals before age 59½ are generally subject to a 10% early-withdrawal penalty, on top of ordinary income tax.
- Missing an RMD triggers a penalty of 25%, which can be reduced to 10% if corrected in a timely manner.
- A properly handled trustee-to-trustee transfer between custodians is generally not a taxable event, since the funds move directly without being distributed to you.
- Tax rules vary by situation. Please confirm your specifics with your tax advisor before acting.

Should you stay in your current coins or swap for bullion?
If you bought so-called “premium”, “exclusive” or “collectible” coins from Rosland Capital, such as the British Museum series, Lady Liberty coins or the PGA tour series to name a few, there’s a good chance you paid a large premium. Court filings describe markups of 30–50%+ over melt value on such gold and silver coins.
That doesn’t mean your metal is worthless — it means the product was most likely overpriced. Your options:

I paid Rosland for gold coins but never got my metal. Can you get my money back?
No. Per court filings, you’re likely an unsecured creditor, and recovery (if any) happens only through the bankruptcy court (Case No. 2:26-bk-16650). No dealer can recover those funds for you.
Do I have to switch custodians now that Rosland is gone?
No. Your custodian and your dealer are separate. You can stay with your existing custodian and simply choose a new dealer when you want to buy or sell.

Be cautious. Rosland’s customer list is being auctioned off, so expect phone calls. You’re not obligated to act on any call — slow down and verify before doing anything.
How do I take my RMD from a gold IRA?

How did Rosland Capital have an A+ BBB rating with 151 complaints in three years?
Because of how the rating works. The Better Business Bureau says its grade is “based on information BBB is able to obtain about the business, including complaints received from the public” — yet it also states that “customer reviews are not used in the calculation of the BBB Letter Grade Rating.”
In other words, the grade reflects whether a company responds to and resolves complaints, not whether its customers were actually satisfied. That’s how a dealer can carry an A+ while clients report being overcharged.
